After FMLA leave, your fiancee returns as a regular employee, with both her and her employer subject to normal processes and procedures. So if by Ohio university you mean OSU, then by policy she would be allowed to use accrued sick leave to cover certain medical issues. However, there are also some limitations. For birth, sick leave time off is limited to available FML. If she used the full FML, then by published and publicly available employment policy, sick leave cannot be used to extend that particular reason for leave. A good faith misunderstanding is certainly legal. Of course if they promised her an exception to the standard policy and then reneged, that's a different matter.
